TERMS OF SERVICE

OVERVIEW

Welcome to Stone Orchard Studio.

The terms “we”, “us” and “our” refer to Stone Orchard Studio. We operate this online store and website, including the information, content, features, products and services made available through it (the “Services”).

These Terms of Service (“Terms”) explain the rules that apply when you access our website, use our Services or purchase products from our Store.

By accessing or using the Services, you agree to these Terms and to the policies referred to in them, including our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms limits or excludes any rights that you have under applicable consumer protection law.

If you do not agree with these Terms, please do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

You may browse our Store without creating a customer account. Where an account or certain information is required to place an order or use a feature of the Store, you agree to provide information that is accurate, current and complete.

If you create an account, you are responsible for keeping your login credentials secure and for activity carried out through your account.

You must not transfer, sell or otherwise make your customer account available to another person.

If you are not legally able to enter into a binding contract in your country of residence, you should use the Services and make purchases only with the involvement and consent of a parent or legal guardian where required by law.

SECTION 2 – OUR PRODUCTS

Stone Orchard Studio jewellery is handcrafted using natural gemstones, pearls and quality jewellery components.

We make every reasonable effort to represent our products accurately through photographs, descriptions, dimensions and other information provided in the Store. However, colours may appear slightly different depending on your screen, device and display settings.

Natural gemstones and pearls are individually unique. Variations in colour, pattern, clarity, inclusions, shape and texture are natural characteristics of genuine materials. Handmade pieces may also have minor individual variations.

Natural variations that are consistent with the product description and the nature of the materials used are not considered defects.

These characteristics do not affect any statutory rights you may have if a product is defective, damaged, incorrectly supplied or otherwise does not conform to the contract.

Product availability may change at any time. We may discontinue products or limit quantities where reasonably necessary.

Some jewellery may also be created according to an individual customer’s specifications or clearly personalised to their requirements. Specific terms applicable to such orders will be communicated before the order is confirmed.

SECTION 3 – ORDERS

When you place an order through our Store, you are making an offer to purchase the selected products.

After receiving your order, we will send an electronic confirmation. An order may be refused or cancelled where there is a legitimate reason to do so, including where:

  • a product is unavailable,
  • payment cannot be authorised,
  • information required to fulfil the order is incomplete or incorrect,
  • there is an obvious pricing or product information error,
  • we reasonably suspect fraud or misuse of the Store,
  • fulfilling the order would be unlawful.

If we cancel an order after payment has been received, the relevant payment will be refunded.

Please check your order details carefully before completing your purchase, including product, size, length, quantity, delivery address and other selected options.

Standard products purchased online may generally be returned in accordance with our Refund Policy and applicable consumer law.

The statutory right of withdrawal may not apply to jewellery that is non-prefabricated and made according to your individual specifications or clearly personalised to meet your individual needs, where the applicable law provides such an exception.

Nothing in this section limits your statutory rights in relation to faulty or non-conforming goods.

SECTION 4 – PRICES AND BILLING

Product prices displayed in the Store are the prices applicable at the time the order is placed.

Prices are displayed in the currency indicated in the Store and represent the product price payable by the customer unless otherwise clearly stated.

Any delivery charges are shown separately before you place your order. Shipping costs may vary depending on the destination country and selected delivery method.

For deliveries within Poland, available delivery methods and applicable rates are shown at checkout.

For deliveries to other European Union countries, the applicable shipping cost is calculated and displayed after the customer provides the relevant delivery destination during checkout.

We may change product prices, offers or promotions from time to time. Changes will not affect orders that have already been accepted.

You agree to provide accurate billing, payment and contact information necessary to process your order.

SECTION 5 – SHIPPING AND DELIVERY

Orders are usually prepared for dispatch within 1–3 business days.

Custom-made jewellery may require additional preparation time. Where applicable, an estimated production time will be communicated to you.

Within Poland, we may offer delivery methods including:

  • InPost Parcel Lockers,
  • InPost Courier,
  • DPD Courier,
  • ORLEN Paczka.

We also ship to countries within the European Union.

Available shipping options, shipping costs and estimated delivery times are displayed during checkout.

Delivery times are estimates and may be affected by circumstances outside our reasonable control. Where applicable law provides otherwise, your statutory delivery rights remain unaffected.

Where Stone Orchard Studio arranges delivery, the risk of loss of or damage to the goods remains with Stone Orchard Studio until you, or a third party designated by you other than the carrier, take physical possession of the goods.

If a parcel does not arrive, is damaged in transit or there is another delivery problem, please contact us so that we can investigate the matter with the carrier.

Nothing in this section limits your statutory consumer rights.

SECTION 6 – INTELLECTUAL PROPERTY

The content made available through the Services, including Stone Orchard Studio branding, text, product descriptions, photographs, graphics, illustrations, jewellery designs, layout and other original content, may be protected by applicable copyright, trademark and other intellectual property laws.

Unless otherwise permitted by law, you may use the Services and their content only for personal and non-commercial purposes.

You may not reproduce, copy, distribute, modify, republish, sell or commercially exploit our protected content without our prior permission.

Third-party trademarks, names, logos and other intellectual property remain the property of their respective owners.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools, features or services supplied by third parties, including payment, delivery, analytics or other technology providers.

These third-party services may be governed by their own terms and privacy policies.

We do not control all aspects of third-party services and are not responsible for matters that are exclusively within the control of those providers.

However, nothing in this section excludes or limits any responsibility that Stone Orchard Studio has towards you under applicable consumer law in connection with your purchase from our Store.

We may introduce, modify or discontinue optional tools and features from time to time.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to websites, platforms or services operated by third parties.

These links may be provided for convenience or to enable particular services. We do not control third-party websites and are not responsible for their independent content, policies or practices.

You should review the applicable terms and privacy policies before using third-party websites or purchasing products or services directly from third parties.

This section does not affect Stone Orchard Studio’s responsibilities in relation to products purchased directly from our Store.

 

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Stone Orchard Studio is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Stone Orchard Studio. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Stone Orchard Studio, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Stone Orchard Studio.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is processed in accordance with our Privacy Policy, which is available through the Store.

Because our Store is hosted by Shopify, Shopify also processes certain personal information in order to provide and operate the ecommerce platform and related services.

Other service providers may process personal information where necessary to provide services such as payment processing, order fulfilment, delivery, analytics or customer communication.

Please review our Privacy Policy for more information about how personal information is collected, used, shared, transferred and protected.

Nothing in these Terms changes the rights available to you under applicable data protection law.

SECTION 11 – FEEDBACK

If you voluntarily provide us with feedback, suggestions, reviews, photographs or other content relating to Stone Orchard Studio or our products (“Feedback”), you confirm that you have the right to provide that Feedback.

Where you make Feedback publicly available or give us permission to use it, you grant Stone Orchard Studio a non-exclusive, worldwide, royalty-free right to reproduce and display that Feedback for legitimate business purposes, including on our website and in marketing communications, to the extent permitted by law.

We will not knowingly use Feedback in a way that unlawfully infringes your rights or the rights of another person.

Nothing in this section limits any rights you have under applicable privacy, intellectual property or consumer protection law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

We make reasonable efforts to ensure that information in the Store is accurate and up to date.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating, for example, to product descriptions, prices, promotions, availability or delivery information.

We may correct errors and update information where necessary.

If an error materially affects an order you have already placed, we will contact you where reasonably possible and explain the available options. Where appropriate, you will be given the opportunity to confirm the corrected order or cancel it and receive a refund.

Nothing in this section allows us to change an accepted order in a way that unlawfully reduces your consumer rights.

SECTION 13 – PROHIBITED USES

You must not use the Services:

  • for any unlawful or fraudulent purpose,
  • to violate the rights of another person,
  • to infringe intellectual property rights,
  • to submit false or misleading information,
  • to transmit malicious software, viruses or harmful code,
  • to interfere with the operation or security of the Store,
  • to collect personal information about other users unlawfully,
  • to harass, abuse, threaten or discriminate against another person,
  • to attempt unauthorised access to accounts, systems or data,
  • to use automated methods in a way that circumvents technical protections or materially disrupts the Services.

We may restrict or suspend access to the Services where reasonably necessary to protect the Store, customers, Stone Orchard Studio or third parties from unlawful, fraudulent or harmful activity.

SECTION 14 – AGENTS

For the purposes of this section, an “Agent” means automated or semi-automated software that accesses or interacts with the Services on behalf of a person or organisation.

Agents must not:

  • conceal or misrepresent their automated nature where identification is reasonably required,
  • circumvent CAPTCHA, access controls or other technical security measures,
  • access areas of the Services without authorisation,
  • interfere with the normal operation or security of the Services,
  • collect information in breach of applicable law or these Terms.

We may use reasonable technical measures to control or limit automated access to the Services.

Nothing in this section prevents legitimate use of technologies such as search engines, accessibility tools or services authorised by Stone Orchard Studio or Shopify.

SECTION 15 – TERMINATION

We may suspend or terminate access to all or part of the Services where reasonably necessary, including in cases of serious or repeated breach of these Terms, fraud, unlawful activity, misuse of the Services or a security risk.

Termination of access to the website does not automatically cancel an order that has already been accepted.

Any outstanding rights and obligations relating to orders placed before termination remain in effect.

Provisions that by their nature are intended to continue after termination, including provisions concerning intellectual property, privacy, liability and governing law, will continue to apply where appropriate.

Nothing in this section limits any statutory rights available to consumers.

SECTION 16 – DISCLAIMER OF WARRANTIES

We aim to keep the Services available, secure and accurate, but we cannot guarantee that the website will always operate without interruption, delay or technical error.

General information made available through the Store is provided for informational purposes and should be considered together with the specific information relating to the product you purchase.

This section does not exclude, restrict or replace any statutory rights relating to goods purchased from Stone Orchard Studio.

Products sold to consumers remain subject to applicable legal requirements relating to conformity with the contract, defects and consumer remedies.

Nothing in these Terms excludes any guarantee, warranty, condition or consumer protection that cannot lawfully be excluded or restricted.

SECTION 17 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms limits your statutory consumer rights in relation to defective, damaged, unsafe or non-conforming products.

To the extent permitted by applicable law, Stone Orchard Studio is not responsible for losses that:

  • were not reasonably foreseeable when the contract was concluded,
  • result from misuse of a product contrary to reasonable instructions or its intended purpose,
  • result from circumstances outside our reasonable control where applicable law permits such limitation,
  • relate exclusively to independent third-party services over which we have no control.

Any limitation contained in these Terms applies only to the extent permitted by applicable law.

SECTION 18 – INDEMNIFICATION

You are responsible for losses or damage caused by your unlawful use of the Services or a material breach of these Terms to the extent provided by applicable law.

Nothing in this section requires a consumer to indemnify Stone Orchard Studio for matters for which the consumer would not otherwise be legally responsible.

Nothing in this section limits any statutory consumer right or transfers responsibility from Stone Orchard Studio to the customer where such transfer would not be permitted by law.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply only to the extent permitted by law.

Where necessary, the affected provision will be treated as severed from these Terms.

The remaining provisions will continue to apply to the extent legally possible.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

The failure of either party to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, product information, order confirmation and any other information that we are required by law to provide before you place an order, govern your use of the Services and purchases made through our Store.

Nothing in these Terms limits or excludes any statutory rights you may have as a consumer.

SECTION 21 – ASSIGNMENT

Stone Orchard Studio may transfer its rights or obligations under these Terms only where doing so does not reduce your contractual or statutory consumer rights.

Where notification of such a transfer is required by applicable law, we will provide it.

You may transfer your rights where permitted by applicable law.

Nothing in this section limits any rights available to you under mandatory consumer protection rules.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of Poland.

If you are a consumer habitually resident in another European Union Member State, this choice of law does not deprive you of the protection provided by mandatory consumer protection rules applicable in your country of residence.

Any dispute will be subject to the jurisdiction determined by applicable law.

Nothing in these Terms limits any right you may have as a consumer to bring proceedings before a court that is competent under applicable consumer protection rules.

Where available, consumers may also use applicable out-of-court complaint and dispute-resolution procedures.

The headings used in these Terms are included for convenience and readability only.

They do not limit or otherwise affect the meaning or interpretation of these Terms.

SECTION 24 – CHANGES TO TERMS OF SERVICE

You can review the current version of these Terms of Service at any time on this page.

We may update these Terms from time to time, including to reflect changes to our Services, business practices or applicable law.

Changes will apply from the date on which the updated Terms are published unless a later date is stated.

Changes to these Terms will not retroactively alter the terms applicable to an order that has already been accepted, unless required by applicable law.

Where required by law, we will provide additional notice of material changes.
